2. Summary of services
The site allows writers, publishing professionals, and publishing-related companies and organizations to conduct fundraising campaigns. The funds from those campaigns can fund specific projects or can be used to pay for the services of various publishing professionals and companies. Site users can also pay directly without crowdfunding.
PubLaunch’s services include all of the functions and content we make available, as well as everything displayed or transmitted on the site. As well, we allow various external suppliers to offer their services to our users.
3. Site availability
Our site is currently a beta version. It will have bugs. Some parts of it don’t exist yet. Your access to the site may be interrupted from time to time as a result of equipment malfunction, updating, maintenance or repair. This site will be constantly changing and evolving. We reserve the right to suspend or discontinue the availability of the site, and any service or material we provide, at our sole discretion and without prior notice. We may also impose limits on certain services or restrict your access to the site and our services without notice or liability.
We do not give any guarantee or warranty of any kind regarding the functionality of the site. Use it at your own risk.
4. Campaign content
A crowdfunding campaign is a combination of the software, text, graphics and such that PubLaunch has provided, and the user’s images, bio, writing sample, opinions and ideas. Content includes, but is not limited to, text, still and moving images, user comments, messages, information, data, graphics, links and software. It’s in everyone’s interests to have all of that work together smoothly and professionally. But we reserve the right to remove any content at any time at our sole discretion and without prior notice. We will remove any content that violates any laws or government regulations, especially copyright laws.
5. User conduct
You are responsible for anything you post to the site. We do not control user-submitted content and do not guarantee the accuracy, integrity or quality of such content. As a condition of use, you promise not to use our services for any purpose that is unlawful or prohibited by these Terms. We could provide a long list of things not to do, but no such list can ever be complete. It’s just the usual stuff: treat people well, don’t offend people, respect copyrights, don’t hack people’s accounts or spam people, be honest and don’t claim things that aren’t true, and generally be a mensch. Misbehave and we’ll terminate your account.
6. Use of your content
We do not claim ownership of your content. It’s yours. Bur we do claim the right to use it once you post it on our site. By creating and posting your campaign you grant us a worldwide, royalty-free, perpetual, irrevocable, and non-exclusive right and license to use, reproduce, modify, adapt, publish and display your content anywhere for all purposes other than sale or redistribution for commercial purposes. You will not be entitled to any compensation for any use by us. We are free to use any of your ideas or techniques for any purpose.
7. Username and password security
To register on the site you must create a username (which must be your real name) and password. You are solely responsible for maintaining the security of your username and password. Do not disclose your username or password to any third party, other than third parties authorized by you to use your account.
You are solely responsible for any use of or action taken under your username and password. You agree to notify us immediately of any unauthorized use of your username and password.
If we disable your account for violating these Terms or for any other reason, you may not create another user profile without our permission.
For service providers and publishers: Your username can be used to offer and provide services using the site, and also to set up crowdfunding campaigns to fund your own projects or those of writers you are working with.
8. Using our service providers
PubLaunch connects you with publishing professionals (such as editors, designers, marketers, hybrid publishers, and so on.) You and the professional service providers will contract on terms – price, schedule, and so on – preferably using our suggested agreement form. PubLaunch is not a part of that agreement.
PubLaunch will calculate the time each service should take to provide, and each publishing professional and service has provided us with the fees they charge. The estimates provided on the site are a combination of those calculations and fees. We believe that the resulting Prices are fair to everyone – service providers and users alike. The service provider will pay PubLaunch an amount equal to 10% of that estimated Price to us as commission for the project (plus any applicable fees and taxes stated on our website).
We provide the site and all content on an “as is” basis and without warranties of any kind. We do not represent that the site will meet your requirements or will be error-free; that the site will be always available or will be uninterrupted; that we will correct any defects, or that the site will be free from viruses or other harmful codes; that the content of the site is accurate or reliable; and that the content or information otherwise accessible through the site does not infringe any third-party rights. You acknowledge that your reliance on any content or any information accessible through the site is at your own risk. User contributions or other content provided by users are solely the opinions and responsibility of the person submitting them and do not necessarily reflect our views.
We have no liability in any circumstances whatever for any data loss or corruption and you agree that you have sole responsibility for protecting your data.
11. Limitation of liability
This agreement is governed by the laws of Canada and Ontario. Any dispute about the services we offer or claim arising out of or in connection with this agreement will be subject to the exclusive jurisdiction of the courts of Ontario.
We may terminate your access to the site or to our services without notice, for any or no reason.
PubLaunch charges 5% of the total fees raised on each crowdfunding campaign plus credit card processing fees, which are managed by Stripe (2.9%).
